Board of Zoning Appeals
Nolensville Town Hall
December 8, 2011- 7:00 p.m.
Members present: Tommy Dugger, Ron Randell, Ken Rucker
Members absent: Jimmy Alexander, Ken Norman
Staff present: Attorney Bob Notestine, Building Official Don Swartz
Vice-Chairman Rucker called the meeting to order at 7:00 p.m. and led the Pledge of Allegiance.
Approval of Minutes
Motion to approve the minutes made by Ron Randell, seconded by Tommy Dugger. The minutes were approved unanimously.
Citizen Comments
None
New Business
Consideration of a request to allow a bed and breakfast and historic home special events as permitted with conditions, located at 7265 Nolensville Road.
The application was considered in two parts. Tommy Dugger made a motion to approve the bed and breakfast, Ron Randell seconded. The motion was approved unanimously.
The second consideration, historic home special events, was considered next. Ron Randell made a motion to approve with Tommy seconding the motion. Discussion with town attorney Notestine indicated that the home owners, The Bennetts are residing at the home as a result of their placing furniture in the home and the fact that they are paying the utility bills for the home. The motion was approved unanimously.
Board member Dugger asked that the Nolensville Planning Commission consider clarifying the meaning of “reside” as it relates to uses requiring such in the Zoning Ordinance.

New Business
Consideration of a site plan to allow the construction of the Church of Jesus Christ of Latter Day Saints facility as a use permitted with conditions at 1646 Sunset Road.
Board member Ron Randell recused himself from deliberation on the application since he is a current member of the LSD church.
Chairman Norman opened the public hearing with the case being presented by Mr. Darwin Shockley. Mr. Gerald Moore, 1664 Sunset Road addressed the Board with concerns about the start of construction, the provision of classrooms and traffic issues.
Mr. Shockley stated that the intention is to start construction in March of 2012, weather permitting. Mr. Kevin Tipps, LDS church, stated that there would be no classrooms.
Following discussion, Tommy Dugger made a motion to approve due to compliance with the listed conditions. Motion to approve seconded by Ken Rucker. Motion approved unanimously.
