Board of Zoning Appeals

The Board of Zoning Appeals is a quasi-judicial board consisting of five members, appointed by the Mayor and confirmed by the Commissioners. It serves to interpret disputed questions of lot lines, grant variances under very specific circumstances, review disputed administrative decisions, grant conditional use permits or similar questions as they arise in the administration of the zoning ordinance.  Authorization is by state law and specified under Section 8.3.4 of the Zoning Ordinance.  Meetings of the Board of Zoning Appeals are typically scheduled to meet at 4:00 P.M. at Town Hall on the second Thursdays of each month. The Board meets on as needed basis.

The powers and duties of the Board include...

ADMINISTRATIVE REVIEW

  • To hear and decide appeals where it is alleged by the appellant that there is error in any order, requirement, permit, decision, determination or refusal made by the building inspector or other administrative official in the carrying out or enforcement of any provision of this chapter.

CONDITIONAL USE PERMITS

  • To hear and decide applications for uses that are permitted in certain zoning districts under special conditions.

VARIANCES

  • To hear and decide applications for variance from the terms of the zoning ordinance, in accordance with the procedures and criteria set forth under Article 1.9.0. of the zoning ordinance. In granting a variance the board may attach thereto such conditions regarding the location, character and other features of the proposed building, structure or use as it may deem advisable in furtherance of the purpose of this chapter. Before any variance is granted it shall be shown that circumstances are attached to the property that do not generally apply to other properties in the neighborhood.

BOUNDARY INTERPRETATIONS

  • Serves to hear appeals to solve zoning district boundary disputes.
