Town of Nolensville Statement Regarding Impact Fee Litigation

As a result of the Charter change referendum, the charter for the Town of Nolensville changed from a Mayor Aldermanic Charter to a City Manager Commission charter. The Home Builders Association of Middle Tennessee filed suit against the Town on December 7th, 2023, seeking to recover all impact fees collected by the Town following the Town’s adoption of the City Manager Commission Charter in 2020. On October 28th, 2025, the Williamson County Circuit Court ruled in favor of the Home Builders Association, finding that the Town lost its ability to impose impact fees by adopting the City Manager Commission Charter. The Court further ruled that, because the Town lost its ability to impose impact fees as a result of the charter change, the Town must return all impact fees the Town collected from members of the Home Builders Association of Middle Tennessee since August 6th, 2020.

The Board of Commissioners will hold an executive session in the coming days to obtain information regarding the ruling. Following that executive session, the Board of Commissioners will determine, at a public meeting, whether to move forward with an appeal to the Tennessee Court of Appeals.
