Zoning Text Amendment

The Board of Commissioners may, from time to time, amend the Zoning Ordinance by changing any provisions whenever it is alleged that there was an error in the Zoning Ordinance or whenever the public necessity, convenience, and general welfare require such amendment. An Amendment of text within the Zoning Ordinance is referred to as a Zoning Ordinance Amendment or a Zoning Text Amendment. Zoning Ordinance Amendments may be initiated by the Board of Commissioners, the Planning Commission, the Zoning Administrator, or by an application of any other interested citizen of the Town.

A Zoning Text Amendment shall meet one of the following requirements:

The use desired is not covered in the text of the zoning ordinance but is acceptable because:

A. The use proposed is in accordance with the purpose of the zoning district; and,

B. There are similar uses in the district; and,

C. The intensity of the proposed use is consistent with other uses in the district;

New conditions have arisen that have not been addressed in the zoning ordinance. These new conditions must be one of the following:

A. The Town of Nolensville Comprehensive Plan has been amended, and the Zoning Ordinance needs to be brought into conformity with the Plan.

B. Changing market or other conditions require new forms of development or new procedures to meet these changing needs.

C. New methods of development or providing infrastructure makes it necessary to alter the Zoning Ordinance to meet their new conditions.

D. Changing governmental finances requires amending the text of the zoning ordinance to be in keeping with the needs of government to provide and afford new public services.

PROCEDURE:

  1. An Application for a Zoning Text Amendment shall be filed for the Zoning Administrator's review by submitting a request with a completed application that is submitted through the Town's online submission portal.

  2. Zoning Text Amendment requests are presented to the Planning Commission for recommendation and then to the Board of Commissioners for final action.
