Rezoning

A rezoning application is a request to change the district boundaries or district classifications of the Zoning Map. A rezoning request should always be supported by the Land Use Plan. Rezoning requests are reviewed by the Planning Commission and acted upon by the Board of Commissioners.

The purpose of a Rezoning request is to change the district boundaries or district classifications of the zoning map for a property including, without limitation, the district assignment of a particular piece of property. Such a change is sometimes referred to as a Rezoning or a Zoning Map Amendment. Rezoning also includes the initial zoning of a property that occurs with an Annexation, when applicable.

Rezoning Request Requirements:

1. Rezonings should correspond with the boundary lines of existing platted Lots, Building Sites, or Tracts. If the boundaries of a Rezoning request stop short of an exterior property line, that portion of the property outside the proposed Rezoning boundary shall be capable of being subdivided in accordance with the Town's Subdivision Regulations and Developed in accordance with the requirements of the Town's Zoning Ordinance.

2. All requirements of the Town's Zoning Ordinance shall be met within the boundaries of the area being Rezoned. If all of the requirements cannot be met on the property proposed to be Rezoned, the Rezoning shall be expanded to include necessary property being used to meet such requirements.

3. As applicable, a Sketch Development Plan meeting the requirements of Section 8.5.6.G shall be provided as part of a Rezoning Application. Without limitation to the foregoing, no proposal for Rezoning shall be approved unless and until an Application for a Sketch Development Plan shall have been approved and-or certified, as applicable, pursuant to Section 8.5.6.G. Submission, approval, and-or certification of such Sketch Development Plan shall not be construed as satisfying the requirement of providing a Site Development Plan as part of an Application for Site Development Plan approval for the property or any part thereof.

4. Without limitation to all other Application requirements, the Rezoning Request Application shall include maps indicating the existing and proposed zoning of all parts of the property.

An application for an Annexation, if applicable, shall be submitted concurrently with the Rezoning request application.

PROCEDURE

Step 1. Preliminary Meeting with the Planning Department
A preliminary meeting with Staff must take place prior to submittal of application. The purpose of this meeting is to discuss the rezoning request in more detail along with the submittal requirements, the review procedures and timelines.

Step 2. Rezoning Request Application Submittal
Rezoning applications shall be submitted according to the Planning Commission submittal schedule to make an Agenda. 

Step 3. Staff Review
Planning staff will review the application and develop a report for the Planning Commission outlining if the request is supported by the Land Use Plan along with any other information staff deems necessary and appropriate to the Planning Commission.

Step 4. Planning Commission - Recommendation
The Planning Commission will review the Rezoning request Application and provide a recommendation to the Board of Commissioners. It is recommended that Applicant is present to answer any questions the Planning Commission may have.

Step 6. Board of Commissioners - 1st Reading
The Rezoning request will be presented to the Board of Commissioners.

The BOC will establish a date for the required Public Hearing for the Rezoning request.

Board will vote to deny the application or to move the Ordinance forward for a 2nd reading.

Step 7. Public Notice

Public Notice is required for Annexation requests. Further details can be found in the Town's Zoning Ordinance.
 
Step 8. Board of Commissioners - Public Hearing
The Board of Commissioners shall conduct properly noticed Public Hearing for the Rezoning request.

The Public will have an opportunity to speak to the Board and express their concerns or support for the rezoning, as well as the Applicant being able to present their request.

Step 9. Board of Commissioners - 2nd Reading - Final Action
The Board of Commissioners will consider the Ordinance and take final action on the request.
