Final Plat

A Final Plat is required to subdivide property.  The Final Plat application is to finalize the layout for subdividing land into two lots, finalize the layout as approved on a Preliminary Plat, document minor changes to lots that shift or consolidate lot lines, create easements and/or any other minor changes that do not involve the creation of new lots.  Final Plats are reviewed and approved by the Planning Commission.

Final Plat approval shall be subject to the dedication and construction completion of all required on-site and off-site improvements, as applicable, including but not limited to streets, sidewalks, sanitary and storm sewers, streetlights, intersection improvements, traffic signals, parks and landscaping or in lieu of completion, the applicant shall sufficient Surety in the form of an irrevocable standby Letter of Credit with an automatic renewable feature, often called an “evergreen” letter and execute an Improvement Guarantee Agreement.

The infrastructure improvements shall be itemized and calculated, in the form of a stamped and signed Cost Estimate reflecting a 25% contingency by the Applicant’s Project Engineer and submitted to the Town Engineer for approval no less than 35 days prior to the Planning Commission Meeting.

If a Surety is being utilized for the required improvements, a Surety Request Application shall be submitted simultaneously with the Final Plat submission.

The recommendation and request for approval of a Surety, in an amount estimated by the Town Engineer as sufficient, will be presented to the Planning Commission outlining the required improvements concurrently with the Final Plat approval request.

PROCEDURE

Step 1. Preliminary Meeting (Optional)

Step 2. Final Plat Application Submittal

Applicants* shall submit a Final Plat application in accordance with the time schedule established by the Planning Commission which is noted on the PC Meeting Calendar.   All of the required supporting documents that are applicable must accompany the application. A list of the requirements can be found on the Final Plat checklist.

*An Applicant refers to the landowner or developer who is responsible to filing with the Town an application for approval of a Preliminary Plan, or the representatives, assigns, successors, transferees, heirs or agents of such landowner or developer.

Surety Request Applications shall be submitted simultaneously with a Final Plat submission. The Surety process and requirements can be found on the Improvement Guarantee - Surety page of the Town's website.

Step 3. Staff Review and Comments

Staff shall review the submittal for completeness and adherence to both the Zoning Ordinance and Subdivision Regulations. Comments will be returned to the applicant according to the submittal schedule which is generally within 10 days of the submittal deadline due date. 

Step 4. Resubmittal of Final Plat - Addressing Staff's Comments

On the date determined by the submittal schedule the applicant should resubmit the Final Plat addressing the comments provided by staff that includes a written response to each comment. 

Step 5. Planning Commission - Final Action

The Planning Commission will take final action on the approval request for a Preliminary Plat as the approving body.   It is recommended that the Applicant is present to answer any questions the Planning Commission may have.

Step 6. Post Surety

If a Surety is being utilized for improvements, following approval from the Planning Commission, the applicant shall have said Surety established within 90 days of the Final Plat Approval. The establishment of a Surety consists of both an executed Improvement Guarantee Agreement & an Original Irrevocable Letter of Credit.

Signatures for the recording of a Final Plat, cannot be obtained by the Town unless the Surety has been established within the allocated timeframe.

Step 7. Submittal of Plans Resolving Conditions of Approval 

If the Final Plat is conditionally approved the applicant should submit the corrected Final Plat reflecting all conditions resolved. 

Step 8. Recording of the Final Plat

After the Final approval of a Final Plat the applicant shall obtain all required signatures and record the Final Plat with the Williamson County Office of Register of Deeds within 90 days of the establishment of the Surety, if one is being utilized or within 180 days of the date of the Planning Commission approval. No lots may be sold from a plat until it has been recorded.
