2010-01 Beer Board Meeting
Beer Board of Nolensville, Tennessee
Nolensville Recreation Center, January 12, 2010, 6:30 p.m.

Members present were Mayor Beth Lothers, Aldermen Jimmy Alexander, Tommy Dugger, Larry
Felts, and Brian Snyder. Staff present was Counsel Robert Notestine, and Town Recorder Cindy
Lancaster. Seven citizens were present.

The Pledge was led by Mayor Lothers.

Uncle Bud’s Catfish, located at 7215 Nolensville Road, submitted an on-premise beer
application to the Nolensville Beer Board. Mayor Lothers noted that the required TBI
background report was submitted to the Board. The Board expressed concern due to a DUI court
date for applicant Mr. Jay Smith was not until the 20th of January. Mr. Smith advised the Board
that he did not feel that it would be resolved at that time. On advice from his attorney this could
be drawn out for more than one-year.

Mr. Craig Dever and Mr. Jay Smith, applicants, advised the Board that historically beer sales
were approximately 1% of their food sales.

Alderman Dugger inquired about the charge of selling beer to a minor in August 2008 at the
Nolensville Feed Mill address operating out of the Uncle Bud’s portable trailer. Mr. Dever
stated that Mr. Darin Scheff was charged with this offense and to his knowledge it had been
resolved. Mayor Lothers inquired to the identification of the person who sold the beer to the
minor. Mr. Dever stated he was not sure who sold the alcohol to the minor.

After extensive discussion, Alderman Dugger made a motion to approve the application with the
condition that Mr. Smith report to the Town Recorder after each court appearance or quarterly so
that the Board could be advised of the outcome to avoid any beer permit holder in Nolensville
comply with the no felony law. In the event there is a felony conviction, the permit will be
suspended and a hearing will be scheduled to hear a new application. Alderman Snyder
seconded and this passed unanimously.

By acclamation the meeting adjourned at 6:57 p.m.

Respectfully submitted, Approved,
