2007-11 Beer Board Meeting

Beer Board, Nolensville Elementary School
Date: November 1, 2007, Time 6:15 p.m.
 
The Nolensville Beer Board met on Thursday, November 1, 2007, and opened at 6:20 p.m. Mayor Beth Lothers, Aldermen Jimmy Alexander, Tommy Dugger, and Ken Thomas were in attendance. Alderman Joe Curtsinger was absent. Staff present was Recorder Cindy Lancaster. There were two citizens present other than the applicant.
 
An on-premise beer permit application was submitted Mr. Ernesto Herrera. He is the manager/owner of Rio Verde Restaurant and is submitting an application for an on-premise beer license at the previous location of Bricks Café, 7240 Nolensville Road, Suite 105.
 
Bricks Café is closing and Rio Verde previously residing at J.T. Williams Grocery is relocating to 7240 Nolensville Road, Suite 105.
 
The applicant addressed the board and introduced himself as Mr. Ernesto Herrera. He told the board that he was before them tonight for a beer license. Mayor Lothers reiterated that they are Rio Verde that was previously located in the Historic District.
 
Alderman Dugger asked if the National background search had been performed on the applicant. Recorder Lancaster stated that it had been ordered although had not come back. She stated that it normally takes approximately ten days. It has been ten days; therefore it should be coming in at anytime. Recorder Lancaster noted that the state background check had been performed and nothing negative appeared on this report.
 
Alderman Dugger noted that the new law states that servers must be certified through the State of Tennessee. He reiterated this is a State law.
 
Alderman Dugger noted that signage has been discussed in the past with other applicants. He noted that although it is not a requirement other applicants have graciously agreed not to put signs in the windows advertising alcohol. Mr. Herrera agreed to abide by this request. Alderman Dugger further requested that he did not want his windows and/or table tops advertising beer.
 
Alderman Dugger made a motion to approve this on-premise permit, contingent on the nationwide criminal search coming back clear. Alderman Alexander seconded and this was passed unanimously.

2007-08 Beer Board Meeting

Date: August 2, 2007, Time 6:30 p.m.
 
The Nolensville Beer Board met on Thursday, August 2, 2007, and opened at 6:40 p.m. Mayor Beth Lothers, Aldermen Jimmy Alexander, and Tommy Dugger, were in attendance. Alderman Joe Curtsinger and Ken Thomas were absent. Staff present was Counsel Robert Notestine and Recorder Cindy Lancaster. There were three citizens present other than the applicant.
 
An on-premise beer permit application was submitted by Mr. Tajinder Kumar for 7240 Nolensville Road, which previously was the Bricks Restaurant. The name has been changed to Brick Stone Cafe.
 
Alderman Dugger asked if the owner was aware of the current law that requires the sellers of beer be certified. Mr. Kumar stated that he has servers that have been serving.
 
Recorder Lancaster noted that Mr. Ron Darden with MTAS is working on an ordinance that will reflect the new state law within the town code.
 
Alderman Dugger noted that in the past this board has requested that signs be kept to a minimum. He agreed.
 
Alderman Dugger asked if the criminal record was good. The recorder stated that the applicant’s Tennessee record was good.
 
Alderman Dugger made a motion to approve with condition that a nationwide or Massachusetts background check be performed and comes back good. Alderman Alexander seconded.
 
This was passed unanimously.
 
Alderman Dugger asked if from now on could a nationwide check be performed. Recorder noted that as long as the 30-day time frame could be adhered to. This board must meet within 30 days from receipt of application. There was discussion on this issue and Mayor stated that more information would be obtained and report back to this board.

2007-05 Beer Board Meeting

Date: May 24, 2007, Time 1:00 p.m.
 
The Nolensville Beer Board met on Thursday, May 24, 2007, at 1:00 p.m. at Town Hall. Mayor Beth Lothers, Aldermen Jimmy Alexander, Tommy Dugger, Ken Thomas were in attendance. Alderman Joe Curtsinger was absent. Staff present was Counsel Robert Notestine and Recorder Cindy Lancaster. There were no citizens present other than the applicant.
 
An off-premise beer permit application was submitted by Mr. Se Won Lee for 7207 Nolensville Road, which currently is the Two Way Stop Market. The name will remain the same, although ownership will change.
 
Alderman Dugger inquired to obtaining a copy of the applicants social security card. It was noted that he could submit the number. Mr. Lee submitted his social security number to Mayor Lothers and this was given to Recorder Lancaster.
 
Counsel Notestine stated that it is his understanding that he must get a permit prior to obtaining ownership. Mr. Lee stated that the closing date for the sale of the property would be next Thursday. Counsel Notestine stated that the town does not normally issue beer license unless it is at the owners request. He noted that this statement is for the boards information and it could be approved contingent upon purchasing the establishment at this location.
 
Mayor Lothers asked Counsel for the proper method of approval. Counsel stated that the motion for approval could be that the permit cannot be issued until proof of acquiring ownership of the business within thirty days.
 
Alderman Dugger noted that in past the town has requested that alcohol neon signs be limited as much as possible.
 
It was noted that the permit was marked for an on premise request. Mr. Lee said that is an error and should be an off premise request. Mr. Lee corrected and initialed his application.
 
Town Recorder Lancaster stated that in speaking with Mr. Trevon Townsend, he is aware that he must surrender his beer permit within fifteen days after the transfer of ownership. Mr. Townsend stated that he has agreed to stay at the store during the 15 day period, although no longer.
 
Alderman Dugger made a motion to approve Mr. Lee’s off-premise permit with condition of final transfer and sale of property. At that time the current owners will relinquish their license within the 15 day period of transfer of ownership, Alderman Alexander seconded. This was approved unanimously.

2007-01 Beer Board Meeting

January 22, 2007, 6:00 p.m. Town Hall
 
The Nolensville Beer Board met at 6:00 p.m. with Mayor Beth Lothers, Aldermen Jimmy Alexander, Joe Curtsinger, Tommy Dugger and Ken Thomas.
 
Applicant Sang Won Hyun with In and Out, Incorporated, located at 7136 Nolensville Road. Ms. Amy Malone spoke for Mr. Hyun noting that he met and would follow guidelines set out locally and at the state level.
 
Alderman Dugger noted that this applicant meets all the criteria and guidelines for an off-premise consumption beer permit and made a motion to approve this permit. Alderman Thomas seconded and this was approved unanimously.
 
Applicant Isaac Wheeler with Wheerler’s Coast In Market, located at 7045 Nolensville Road noted that he did not want to change anything in regards to the current beer application. Mr. Wheeler did state that he would be cleaning up the facility and noting that he would be removing a trailer that was located in the rear of the property. Although, he would not be making any major changes. He further noted that he has owned the establishment for approximately 30 years.
 
Mayor Lothers asked if he was familiar with state and local regulations. Mr. Wheeler stated that he was aquainted with the regulations. Alderman Dugger that this applicant meets all the criteria and guidelines for an off-premise consumption beer permit and made a motion to approve this permit, Alderman Alexander seconded and this passed unanimously.
