Site Development Plan

Site Development plans are meant to be the construction documents from which an applicant would pull grading/site/building permits.  All non-residential/commercial/industrial uses, attached residential buildings or building improvements that require a building permit must first have an approved site plan. Approved site plans must be included in any building permit application. Site plans are reviewed by staff and approved by the Planning Commission.  Flow Chart

Step 1. Pre-Application Conference
Applicants are required to contact the Planning Department and schedule a pre-application conference to discuss the proposed project and town requirements. This meeting is the primary method for obtaining a Certificate of Completeness. 

Step 2. Application Submittal 
Applications should be submitted according to the Submittal Schedule. Fees are due upon submittal. For a list of submittal requirements see Section 8 of the Zoning Ordinance. A tree removal/replacement chart should be provided upon submission. Submit 3 paper copies and a USB drive with all submittal materials in pdf format to the Planning Department.  Additional documents and information may be required by the Engineering Department. Applicants should contact Engineering at 615.776.3323 concerning the need for additional informational. 

Step 3. Completeness Review
1. Within fifteen (15) days of submission of a Development Plan Application, the Zoning Administrator shall review and determine whether the Application is complete.

2. If the Zoning Administrator determines that the Development Plan Application is complete, he shall issue a Certificate of Completeness and, in the case of a Site Development Plan that is subject to review by the Planning Commission, forward such Certificate and the Development Plan Application to the Planning Commission for review and action, and shall notify the Applicant that the Application has been certified as complete and, if applicable, forwarded to the Planning Commission for consideration.

3. If the Zoning Administrator determines that a Development Plan Application is incomplete, he shall notify the Applicant of such determination with a written explanation regarding which items are incomplete, and shall return the Application to the Applicant.  

Step 4. Staff Review

PLANNING DEPARTMENT  REVIEW:
Staff reviews the submittal for adherence to the Zoning Ordinance and Subdivision Regulations. Comments are returned to the applicant according to the submittal schedule.  Comments are generally returned to the applicant ten days after the submittal. 

STORMWATER ENGINEERING DESIGN REVIEWAll application plan submittals must include stormwater engineering design that complies with Ordinance #18.04. A copy of Ordinance #18.04 is available at https://www.nolensvilletn.gov/departments/engineering/stormwater_information.php.  Stormwater engineering design review is conducted by our outside consultant Michael Phillips with Neel -Schaffer.  Mr. Phillips can be reached at (615) 383-8420, or via email at mike.phillips@neel-schaffer.com.  Applications will not be agendized for Planning Commission consideration until a conditional approval letter is received by Mr. Phillips and approved by the Town Engineer.  For any questions on compliance with Ordinance #18.04, please contact Don Swartz, P.E., Town Engineer at 615-776-3323, or email him at dswartz@nolensvilletn.gov.

FIRE DEPARTMENT REVIEWAll application plan submittals must include fire infrastructure design and adequate turn around areas that are in compliance with International Fire Code. Fire infrastructure design review is conducted by our Fire Marshal Matthew Lupo.  Mr. Lupo can be reached at (615)-719-3102, or via email at mlupo@nolensvilletn.gov.  Applications will not be agendized for Planning Commission consideration until a conditional approval letter is received by Mr. Lupo and approved by the Town Engineer.  For any questions on compliance with International Fire Code, please contact Matthew Lupo. 

Step 5. Public Notice 
Ten days prior to the prior to the Planning Commission, Board of Commissioners, or Board of Zoning Appeals meeting, as applicable, the applicant is required to send out a mailed notice to all adjacent property owners. A sample notification letter is provided here.  A notarized affidavit should be submitted to the Planning Department with a sample letter.  The applicant must also place a sign on the subject property, and this sign must be on the property and clearly visible for at least ten days prior to the meeting. The Town will place a notice in the local newspaper prior to the meeting.


Step 6. Resubmittal of Plans

The applicant should resubmit their plans to the Planning Department according to the Submission Schedule. The plans should address each of the comments made by staff and a written response should be included with the resubmittal. Failure to meet the resubmittal deadline requires a plan to start at the beginning of the process. 


Step 7. Planning Commission
Site plans placed on the agenda and the applicant will be allowed to make a presentation to the Commission. The Planning Commission will approve, approve with conditions or disapprove a site plan. Site Plans do not proceed further for approval. 

Step 8. Submittal of Plans Correcting Conditions of Approval
When the applicant has addressed and resolved all conditions of approval a final set of plans should be submitted to the Planning Department.

Step 9. Bonds Posted
Prior to the issuance of a building permit or the recording of a final plat sureties must be posted.  The guidelines for the process are HERE
